Terms and Conditions

1.    Wedding Cake Consultations
Wedding cake consultations are available via zoom (video call) only. Consultations are free of charge and can be booked at a time to suit you. If you want to cancel or change your video call appointment time/day, please let us know as soon as possible. Please note you may also order a taster kit to arrive and to try alongside the consultation, incase you have any questions regarding our flavours. We will do our best to ensure this arrives closest to the appointment call, but specific days for delivery can’t be chosen. All our cakes, including our taster cakes, are made in an environment that handles ingredients that contain gluten, dairy, eggs and nuts, so traces of these may be found in any of our cakes. 

2.    Taster Kits
Taster kits are available for £25. This is a non-refundable fee as it covers ingredients, time, post and packaging. Our taster kits include four flavours choices and are sent via first class post. Each kit contains eight pieces of cake as you will receive a portion of each flavour for both you and your partner. We can’t be held responsible if these kits fail to arrive within the allotted time. However a replacement will be sent out in due course. If you require a second taster kits, for yourself of to send to family or friends, additional sample boxes may be purchased for £25. There is a maximum of two sample boxes per order.

3.    Enquires/Booking
Unfortunately an enquiry does not hold the date for you, the only way to secure a date is to pay a non-refundable 30% deposit via cash, cheque or BACS transfer. If your order balance has not yet been confirmed the deposit fee is £120. All cheques need to be made payable to ‘The Flamingo Bakery’. The date will not be held until the payment has been received or the cheque has cleared. Unfortunately, making an initial enquiry about a certain date or receiving a quote does not automatically reserve the date for you as we may be liaising with multiple customers at one time for the same date due to the amount of enquires we receive each day. Therefore we work on a first come, first serve basis.

4.    Placing your order/Payment Terms
To confirm an order, a non-refundable deposit of 30% of the balance is required. This will secure your requested date and order.
If you wish to have alterations that affect the cost, after the deposit has been paid, the balance will be adjusted accordingly. Reasonable changes to your order may be made up to eight weeks prior to your wedding date and must be confirmed in writing. Additional costs may be incurred depending on the nature of the changes. We cannot guarantee that we will be able to make any alterations once the order confirmation has been sent out but we will always do our best to accommodate changes wherever possible. Payments can be made by bank transfer.  We do not currently accept card payments. 
For all orders, the outstanding balance can be paid any time up to 14 days before the delivery date and can be paid in instalments or in a lump sum. Failure to pay by the required date will incur an additional charge of £5 per day, over the original due date. If the full outstanding balance, including any incurred fees, isn’t received 72 hours before the delivery date, we withhold the right to cancel your order and refuse delivery. All payments made up to that point will not be refunded.  
Please let us know when placing your order if you require delivery at a specific time. Otherwise delivery will be arranged with you or your venue, before the delivery day, at a time that suits all parties involved.

5.    Cancellation Policy / Postponements
All deposits are non-refundable. Any orders booked and secured with a deposit from 1st April 2020 onwards are booked at your own risk as deposits are still non-refundable no matter any changes in government policies due to COVID-19. 
For all bookings, if you cancel your order for any reason up to three months before the delivery date, all other monies paid except the 30% deposit will be refunded by bank transfer. If your order is cancelled less than three months from the requested date, you will receive no refund. If you are postponing your wedding to an alternative date we accommodate this whenever we have availability to do so. Any orders which change to the following year will be subject to an additional 20% charge to cover inflation costs.

6.    Delivery & DHL
All our products are available via our one to one delivery service. This is charged at a standard rate of 50p per mile and includes the return journey. We also charge for our time travelling as well as during the set up. The set up of each cake usually takes us around 40-60 mins on site. We can’t be held responsible for any delays due to traffic/accidents during delivery which are out of our control.
Unfortunately we don’t offer a collection service. 
Personalised biscuits can be posted via DHL and normal DHL costs apply. Any posted items such as our personalised biscuits are couriered at your own risk and we cannot accept liability for any damage or loss, therefore we do advise you where ever possible to choose to use either our one to one delivery service or to collect items in person. 
We accept no liability if delivery is unable to be made due to the recipient being unavailable
Once an order has been collected or delivered, the full responsibility for the safety of the product is with the client and The Flamingo Bakery will not be responsible for any damage to the product after its been collected. The same applies for any products that are delivered via our delivery service. Once the cake has been fully set up and left at a venue, we cannot be held responsible to anything that happens to the cake once we leave. 

7.    Product and Design
We will always do our best to match any colours given to us by customers however we cannot guarantee the match will be exact. 
At the request of the client, cakes sometimes contain in-edible items due to the cake design such as broaches, dowels, wooden supports, ribbons, flowers and feathers etc. These items must be removed before serving and we accept no responsibility for any harm these might cause if not removed correctly.
We can provide flowers to decorate your cake, or we will liaise directly with your florist. Please be aware that some flowers are not suitable for cake decoration, or may be toxic if eaten. It is not our responsibility to check the nature of the flowers provided from your florist. All flowers and foliage must be removed before serving. Any contamination to your cake from florists flowers or any additional decorations added from other suppliers, is not our responsibility.
Unless otherwise specified all our products contain butter, gluten (wheat) and eggs and are made in an environment that handles nuts, soya and alcohol. Gluten-free and alcohol-free cakes can be made on request but we cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of production.
The Flamingo Bakery accepts no liability for customers suffering allergic reactions from eating our products. It is the customer’s responsibility to make us aware of any special dietary requirements that need to be accommodated in the making of their cake but as stated above all cakes may contain gluten, soya, nuts, eggs, dairy and alcohol. 

8.    Publication and promotional rights
By signing the order form the customer agrees that the company is the sole designer and owner of the final cake design. All rights in any original designs created and designed by the company shall remain the exclusive property of the company. From time to time our designs are published in the media e.g. wedding magazines. We reserve the right to use any image of a customer's cake made by the company for publication after the delivery date unless previously agreed in writing between the customer and the company.
The customer has no ownership rights over any cake design. Exclusivity of cake designs between our customers is not guaranteed unless the customer commissions an exclusive design and mentions this specifically in written form.

9.    Stand Hire
Cake stands can be hired from £20.00-£40.00 per cake stand, plus a refundable £20.00-£80.00 deposit. All stands are hired on the agreement that they must be returned to us within three working days after your wedding as these stands may be required for another wedding cake the following week. Once the stands have been returned to our bakery in perfect condition and within the allotted three working day timescale, we will transfer you the deposit back, via a BACS transfer.  If the stand is not in its original condition after use or it arrives back later than three working days, we withhold the right to retain the full deposit and stand hire cost. 
We are happy to use any cake stands that are being provided by either the customer or a venue, however it is not our responsibility to ensure the cake stand is suitable, level or strong enough for the cake. Once the cake has been fully set up on the stand, we cannot be held responsible to anything that happens to the cake once we leave. We do withhold the right to refuse to use a cake stand at any point, if we feel it is unsuitable and could cause damage to the cake. 
We collect any hired cake stands from your wedding venue and the cost for the collection service is included in the hire fee.

10.   Collections
As soon as any goods are collected by a customer and they leave our premises, all responsibility transfers to the customer/persons collecting the goods and all items are taken at their own risk. The Flamingo Bakery cannot accept liability for any damage or loss for any goods once they leave our care. Customers will also be asked to sign a document stating their understanding of these terms. No goods can be collected until the document has been read and signed. Once any goods has been collected they become solely the customers responsibility to ensure the goods are stored correctly and safely. All our cakes, must be stored in a cool, dark & dry area, free from humidity. We also advise that all our sponge cakes should be eaten with in three days from delivery/collection. Extra care must also be taken when driving with any collected goods, ensuring no heavy breaking, fast cornering or quick acceleration is key, as this can lead to both internal structural damage and external visual damage.  

11.    If you are not happy
If you are not 100% happy with your cake for any reason please contact us within 10 hours of collection/delivery so we sort this for you. We will also need to see the cake in person or have sufficient photographic evidence in order to issue any refunds.

12.   Postponements
As of February 2020 onwards, we are happy to postpone your wedding cake booking if your wedding has to be delayed due to COVID-19. This will be subject to our availability. Any full cancellations will be subject to our normal terms and conditions as stated in point 5. above. First postponements are free of charge. If you have to postpone for a second time, unfortunately this will incur a £50 charge to cover admin costs and loss of potential earnings from the original unused date. Any postponements are also subject to an additional inflation charge at the current rate. This is non-negotiable and will be invoiced immediately on change of date requiring payment within 14 days.
